Who I am
I, Ishu Kumar, trading as Attiv AI ("I", "me"), run a sole proprietorship based in Ghaziabad, India. In these terms, "you" means the person or business using this website or my services.
My services
I design, build and run software, automations and websites for businesses. The exact work, timeline and deliverables for each project are set out in a written proposal or agreement that you approve before work starts.
Information on this website is a general description of what I do. It is not an offer, and it does not create a contract on its own.
Quotes and payment
Every project starts with a written quote. A quote is valid for the period stated on it. Work begins once you accept the quote and any agreed advance payment is received.
Payments follow the schedule in your proposal, for example milestone payments for a fixed-scope project or a monthly fee for a retainer. Applicable taxes are added as required by law.
Work outside the agreed scope is quoted separately before it is done.
Ownership of the work
Ownership of the intellectual property in the code, designs and content I create for you is agreed in writing in your project proposal or agreement.
Third-party software, open-source libraries and services used in the work remain under their own licences. General tools, know-how and reusable components I already had, or build for general use, remain mine, and you receive a permanent licence to use them as part of your delivered work.
I may mention that I worked with you in my portfolio only with your permission.
Confidentiality
I keep your business information confidential and use it only to deliver the work you asked for. I do not share it with anyone except service providers needed to do that work, or where the law requires it. If you prefer, I can sign a separate non-disclosure agreement before you share details.
Your responsibilities
You agree to give me accurate information, timely feedback and the access I need to do the work. You confirm that you have the right to share any data, content or accounts you give me.
Limitation of liability
I take care to deliver work that does what we agreed. To the extent the law allows, my total liability to you for any claim related to a project is limited to the fees you paid me for that project. I am not liable for indirect or consequential losses, such as lost profit, lost data or business interruption.
Nothing in these terms limits liability that cannot be limited under Indian law.
Use of this website
You may browse this website and contact me through it. Please do not misuse it, attempt to break its security or copy its content for commercial use without permission.
Changes to these terms
I may update these terms from time to time. The date at the top shows when they last changed. Signed agreements keep the terms that applied when they were signed.
Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute will be handled by the courts at Ghaziabad, Uttar Pradesh.
